Domain Stealing

Question:

My employee registered a domain name of a product line he is dealing with at work?and started his own website. The contract does not explicitly say he can’t do it.

Do I have any legal power to get it from him?
Answer:

If the website infringes on a trademark or copyright then you would have good grounds to file a simple request to take the website domain from him. This can be done through arbitration etc. before even going to a court type of setting and can be done rather cheaply.

The information you need for domain disputes is located on the ICANN website at: http://www.icann.org/en/udrp/udrp.htm

There is a lot of free information there about how you can resolve the domain dispute. Also, you may want to check other domains that are similar to the product line and register a few for your own use. You can use them to run different promotions, contests, test out new landing pages etc.

Hope this helps! Getting the domain back can be a bit of a pain, but it is VERY doable for most people and can be done for cheap.
